opposing the ordinance tooth and nail Image used for representational purpose only Firstpost The TRS was unhappy with the Cabinet decision and called the move for an ordinance "unconstitutional" All order is akin to putting band-aid over a festering wound caused by its inefficient decisions on coal pricing and allocation The agency is a poor substitute for the coal regulatory authority (CRA) that the Centre attempted to create through legislation — the CRAI bill is stalled in Parliament Without a legislative mandate the regulatory body will simply serve as an advisor to PSUs in the coal sector Coal India Limited would still have the final say in important decisions like pricing as well as the allocation of coal blocks The regulator in its current avatar can frame “principles and methodology” in pricing but unlike in the case of the CRAI failure to comply with them will not result in corrective action The regulator will have no decisive role in the cancellation or suspension of mining licences It is also unclear how a non-statutory body can effectively adjudicate disputes between PSUs and buyers At the heart of the coal allocation controversy is the allegedly irregular manner in which the ministry of coal auctioned coal blocks The Comptroller and Auditor General of India has emphasised how auctions did not follow a competitive bidding process While the CAG may have overstepped its mandate in projecting “notional losses” from coal allocation there can be no denying its observations on opaque decision-making Left to ad hoc screening committees inter-ministerial groups and empowered groups of ministers there has been little transparency let alone oversight in the allocation and de-allocation of blocks The Centre has given scant regard to best practices in public procurement which raises questions about the effectiveness of interventions from an advisory body A weak coal regulator will lose face if the PSUs that have a monopolistic hold on the market ride roughshod over its recommendations Having a regulatory authority in this field could bring in much-needed checks and balances in the process of determining the sale of a scarce and valuable national resource But if its recommendations have no legal bearing on executive decisions the coal regulator will only duplicate the CAG’s work raising red flags without any tangible effect on arbitrary or corrupt practices For all the latest Opinion News download Indian Express App More Related NewsWritten by A Kameshwari | New Delhi | Published: August 3 2017 6:40 pm Akshay Kumar to Diego Costa Premier League champions bought the Spaniard from Spanish giants Real Madrid in a 58 million signing Owen told mirrorcouk”I have question marks over Morata he did well in Italy but he was never a starter at Real Madrid He scored goals off the bench but I’ve played for them and you’re always going to score in that team given Real score four or five most weeks and you’ve always got the ball unless you’re against Barcelona” “There’s no doubt he’s a decent player but he’s never played in the Premier League before which could be a factor in how well he does” In 14 appearances for the Spanish Champions Morata scored 15 goals gaining limelight On the latest transfers that took place this season Owen said “The strikers have certainly made the headlines on top of all the spending that’s been going on I think Arsenal are stronger with the signing of Alexandre Lacazette United are probably stronger with Romelu Lukaku coming in but Morata over Costa at Chelsea Thats’s the big gone beyond the provisions of the new Companies Act While the act mandates that a defined percentage of profits should be devoted to socially useful activitiesit leaves individual companies free to choose which activitiesonly broadly indicating what is considered socially useful Chhattisgarhs Corporate Social Responsibility Policy 2013 makes it compulsory for companies to pay CSR contributions into the Chief Ministers Community Development Fundwhose purpose is the holistic development of districts affected by mega industrial projects The Chhattisgarh State Industrial Development Corporationwhich will operate the fundwill pass on the amounts to the concerned district Non-compliance is punishable by the withholding of grants or facilities by the state governmentalbeit after a hearing Admittedlycompanies have not contributed to the welfare of local communities as much as they can and should Or it has been done in such an ad hoc manner that there is a disconnect between the needs of the community and the local industrys plans for it The Central enactment and state policies have brought the need for CSR into the corporate consciousness Howeverthe Chhattisgarh policy is misconceived for a variety of reasons Making companies channel their CSR resources into a common pool under state control runs counter to the spirit of CSRwhich is to encourage companies to be responsible for the welfare of communities because it is in the interests of both company and community Ultimatelythe business of business is businessnot social development It will contribute to the latter only when it becomes obvious that the goodwill generated by the CSR contributions adds to the bottom line in the long runthat isout of enlightened self-interest A company is interested in doing goodeven if out of compulsionif it can also be seen to be doing good This means the community must be aware of the identity of the donor company Moreovera company would always prefer direct engagement with the community because it provides greater psychological satisfaction The pooling of CSR resources into a common kitty creates a disconnect between the company and the communityand transfers the credit from the company to the government and politicians who dispense the largesse as part of their own agenda The new policy also raises the questions of whether state disposal of wealth is more efficient than private agencywhether the state should directly control the utilisation of private charitable resources (although mandated CSR is not exactly a charitable contribution) The experience of state control of philanthropic funds would suggest that both answers are in the negative The National Culture Fund (1996) and the Bharat Shiksha Kosh (2003) were set up to mobilise funds from private sourcesbut both failed to meet their objectives That they could not attract contributions was partly to do with state control of the funds donated Even those who did not mind the funds as a mechanism to mobilise resources objected to routing these through governmentand withdrew Though companies have no such option in the present casethe government will lose an opportunity for innovative development with private cooperation The idea of creating a large pool of charitable resources to supplement government budgetary provision is not bad in itself Individual corporate initiativeswhile useful in themselvesare often unable to effect sustained change on a large scale because they are not linked to larger national goals and government programmes The Chhattisgarh fund can perhaps help provide this scale and the linkagesprovided the private donors are allowed a say in the operation of the fund It might be best for the state to leave CSR funds in private handsand to indirectly control the flow of funds into the desired fields One suggestion is to encourage the establishment of community funds out of CSR contributionsowned and run by the people in partnership with the donor companiesin the locations where they are needed The government could participate as partner instead of ringmaster Sundar is the author of Business and Community: The Story of Corporate Social
